1. Introduction and Acceptance of Terms
Welcome to our edtech platform. By accessing or using our online reading and gamified learning courses (the "Platform" or "Services"), you agree to these Terms and Conditions
("Terms"). These Terms form a legal agreement between you (the user) and the Platform operator (hereinafter "Company," "we," or "us"). Please read them carefully. If you do not agree
with any part of these Terms, you should not use our Services.
We do not impose any age restrictions on who can use the Platform. However, if you are under 18 years of age, we strongly recommend that you use our Services under the supervision of a
parent or guardian. By using the Platform, you confirm that you are either at least 18 years old, or if you are a minor, that your parent/guardian has reviewed and agreed to these
Terms on your behalf. We may update or revise these Terms from time to time. We will notify users of any significant changes, and the updated Terms will be posted on our website.
Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
2. Description of Services
Our Platform offers online reading materials and gamified learning courses designed to make education engaging and accessible. The Services include interactive lessons, educational
games, quizzes, and other content to help users learn various subjects in a fun way. Users can read content, watch instructional materials, and participate in game-based exercises to
reinforce learning.
All courses and content are provided for personal educational purposes. We aim to supplement your learning experience, but our Services are not a substitute for formal education or
accredited programs. Using our Platform does not guarantee any specific results or academic success. The availability of courses may change from time to time, and certain content may
be updated or removed as we improve our offerings. You are responsible for ensuring you have the necessary internet connection and compatible devices to access the Services.
3. User Responsibilities
When using our Platform, you agree to act responsibly and abide by the following obligations:
-
Provide Accurate Information: You agree to provide true, accurate, and current information about yourself as requested (for example, during account creation or
course enrollment). If any of your information changes, you will update it promptly.
-
Use for Intended Purpose: Use the Platform and its content only for personal, non-commercial learning and enrichment. You are responsible for how you use the
knowledge gained. Do not use the content for unauthorized commercial activities (such as reselling course materials or engaging in plagiarism).
-
Compliance with Laws: You must use the Services in compliance with all applicable laws and regulations. This includes not using the Platform for any unlawful purpose
or in a way that infringes the rights of others.
-
Respect Others: If the Platform allows communication with instructors or other learners (e.g., forums, comments), you should interact respectfully. Do not engage in
harassment, hate speech, bullying, or any behavior that negatively affects others' experience.
-
Parental Guidance for Minors: If you are a parent or guardian allowing a minor to use the Platform, you assume responsibility for the minor's use. You should
supervise the learning experience and ensure the minor understands and abides by these Terms.
By fulfilling these responsibilities, you help us maintain a safe and productive learning environment for everyone. If you fail to meet these obligations, it may result in suspension
or termination of your access to the Services (see Section 8 on Prohibited Activities).
4. Account Registration
To access many of our courses and features, you may need to create an account on the Platform. When registering for an account, you agree to the following:
- Registration Information: You will provide a valid email address, your name, and any other required details truthfully.
-
Account Security: You are responsible for maintaining the confidentiality of your login credentials (username and password). Do not share your account password with
anyone.
-
One Account Per User: Unless expressly permitted, you should create only one account for yourself. Having multiple accounts or sharing your account with others is
prohibited as it may lead to misuse of the Services.
-
Responsibility for Account Activity: All activities that occur under your account are your responsibility. If someone else uses your account (with or without your
permission), you are still accountable for their actions on the Platform. The Company will not be liable for any loss or damage arising from unauthorized use of your account, so
please keep your credentials safe.
-
Profile Management: You should keep your profile information (such as contact details) up to date. This ensures we can reach you with important announcements or
information regarding your courses or account.
If you encounter any issues during registration or login, or if you need to deactivate your account, please contact us for assistance. We reserve the right to refuse registration, or
cancel or suspend accounts, at our discretion if we suspect violation of these Terms or any improper activity.
5. Payment and Pricing
Certain courses or content on our Platform may require payment before you can access them. By making a purchase on the Platform, you agree to the following terms regarding payments and
pricing:
-
Pricing Information: All prices for courses or subscriptions are listed in Indian Rupees (INR) unless stated otherwise. We strive to ensure that all pricing
information on our Platform is accurate and up-to-date. However, in case of any pricing error or discrepancy, we reserve the right to correct it (we will inform you if a correction
affects your pending purchase).
-
Payment Process: Payments for courses are typically one-time (per course purchase) or on a subscription basis (if offered). You will be clearly informed of the fees
and payment schedule (if applicable) before you confirm any purchase. Payments can be made through supported methods such as credit/debit cards, UPI, net banking, or other online
payment gateways. By providing your payment information, you represent that you are authorized to use the chosen payment method and authorize us (or our payment processor) to charge
the applicable fees.
-
Taxes and Fees: Course fees may be subject to applicable taxes (e.g., GST). Any such taxes or additional charges will be shown at checkout or included in the price.
You are responsible for any charges your bank or payment provider may impose for processing the transaction (e.g., foreign transaction fees if you use an international card).
-
Payment Confirmation: After a successful transaction, you will receive a payment receipt or confirmation (onscreen and/or via email) summarizing your purchase.
Please keep this for your records. If you do not receive confirmation or encounter any access issues post-payment, contact us promptly.
-
Price Changes and Promotions: We reserve the right to change the price of any course or subscription, or introduce new fees, at our discretion. Any price change will
not affect purchases that have already been completed; new prices will apply only to future purchases or renewals. We may also offer discounts or promotional offers occasionally.
These are time-limited or subject to conditions, and unless the offer explicitly applies to you, standard pricing and terms will remain in effect.
-
Failed Payments: If a payment fails or is declined (due to issues like insufficient funds or incorrect information), your purchase will not be completed and you will
not get access to the course until a successful payment is made. It is your responsibility to ensure your payment details are correct and that you have sufficient funds. We are not
liable for any fees or penalties charged by your bank in case of a failed transaction.
All payments are subject to our Refund Policy outlined below. Please review the refund terms carefully, especially our 7-day conditional refund offer, before making a purchase.
6. Refund Policy (7-Day Conditional Refund)
We want you to be satisfied with our Services. If you purchase a course and find it isn't what you expected, we offer a fair refund policy as outlined below:
-
7-Day Refund Window: You are eligible to request a refund within 7 days from the date of purchase of a course. After 7 days, we will not accept refund requests for
that course.
-
Completion Threshold: Refunds are only available if less than 10% of the course has been completed. We track your progress in the course (for example, lessons or
modules completed, time spent, and quizzes attempted). If our system shows that you have accessed or completed 10% or more of the course content, you will not be eligible for a
refund, even if you are within the 7-day window. This policy is to prevent abuse of the refund system while still being fair to learners who quickly realize a course isn't right for
them.
-
How to Request a Refund: To initiate a refund, contact our customer support within the 7-day window. You can reach us via email or phone (see Section 11: Contact
Information) with your purchase details (such as the order ID, course name, and date of purchase). It will help (but is not required) to let us know why you're unsatisfied. We aim to
make the process hassle-free.
-
Refund Approval and Process: Once we receive your refund request, we will verify that it meets the criteria (purchase date and completion percentage). If approved,
we will notify you and process the refund to the original payment method used. Please note that it may take several business days (typically 5-10 working days) for the refunded
amount to reflect in your account, depending on your bank or payment provider. Access to the refunded course will be revoked once the refund is processed.
-
When Refunds Are Not Granted: If your request is outside the 7-day window or you have exceeded the 10% completion threshold, we will unfortunately not be able to
issue a refund. Additionally, abuse of the refund policy (for example, repeatedly buying and requesting refunds or any fraudulent behavior) may result in denial of the refund and
potential suspension of your account. Our goal is to be fair, so we assess refund abuse on a case-by-case basis.
-
Exceptions: This refund policy applies to courses purchased directly through our Platform. If a third-party platform or app store is involved in the transaction,
their refund policies may apply (we will assist you in understanding those if needed). Also, free courses or free trial periods are not eligible for refunds since no payment is made.
This policy does not affect any statutory rights you have under consumer protection laws.
If you have any questions about whether you qualify for a refund, or if you need assistance with the refund process, please contact us. We value our users and will do our best to
address your concerns.
7. Intellectual Property Rights
All content and materials available on the Platform are protected by intellectual property laws and are the exclusive property of the Company or its content providers. By using our
Services, you acknowledge and agree to the following with respect to intellectual property:
-
Ownership of Content: The Platform's content – including but not limited to text, articles, course materials, lessons, videos, images, graphics, animations,
software, and games or quizzes – is owned by or licensed to the Company. This content is protected by copyright, trademark, and other intellectual property laws in India and
internationally. We (or our licensors) retain all rights, title, and interest in and to the Platform and its content.
-
Limited License to You: When you enroll in a course or use our Services, the Company grants you a limited, non-transferable, non-exclusive license to access and use
the content for your personal, non-commercial educational purposes only. This means you may view and interact with the content, and download materials if explicitly made
downloadable, solely for your own learning. No other rights are transferred or granted to you. You may not transfer or sub-license this access to anyone else.
-
Restrictions on Use: You must not copy, reproduce, distribute, publicly display, or create derivative works from any content on the Platform without our prior
written permission. For example, you cannot share course videos on YouTube, print and sell our course notes, or translate our content and post it elsewhere. Also, you may not
reverse-engineer, decompile, or attempt to extract the source code of any software or tool on the Platform (except as allowed by law).
-
Trademarks: The Company's name, logo, and any product or service names or logos of the Platform are trademarks owned by the Company. You are not permitted to use
these trademarks without our written consent. All other trademarks appearing on the Platform (for example, the name of a partner organization or a referenced book) are the property
of their respective owners.
-
User-Generated Content: If the Platform allows you to post or submit content (such as comments, reviews, or project work), you retain ownership of your content.
However, by submitting content on the Platform, you grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content in
connection with operating and marketing the Services. Please only submit content that you have rights to share. You also agree not to upload any content that violates the
intellectual property or privacy rights of others.
We respect intellectual property rights and expect our users to do the same. If you believe that any content on the Platform infringes upon your copyrights or other rights, please
notify us immediately (see Section 11 for contact details). We will promptly investigate and, if necessary, remove the infringing material. Similarly, if a user is found repeatedly
infringing intellectual property rights, we may terminate or restrict their account in accordance with our policies and applicable laws.
8. Prohibited Activities
To maintain a safe, lawful, and respectful environment, users of our Platform must not engage in any of the following prohibited activities:
-
Illegal Activities: Do not use the Platform for any purpose that violates local, state, national, or international laws or regulations. You agree not to engage in or
promote any illegal activity while using our Services.
-
Infringing Rights: Do not upload, post, share, or transmit any content that infringes or violates another person's intellectual property rights or other rights. This
includes not sharing course materials outside the Platform in violation of Section 7, and not using any content you don't have rights to use.
-
Unauthorized Access: Do not attempt to gain unauthorized access to the Platform, other users' accounts, or any computer systems or networks associated with the
Platform. This means no hacking, password mining, or circumventing any access controls or security measures put in place.
-
Malicious Software: Do not introduce or transmit any harmful code or software through the Platform. You must not upload viruses, worms, malware, or any other content
that could interfere with the operation of the Platform or harm other users' devices.
-
Disruption of Service: Do not interfere with or disrupt the integrity and performance of our Platform or the data contained within. Avoid any action that imposes an
unreasonable load on our infrastructure (such as using automated scripts to scrape data or send excessive requests). Also, do not attempt to disable or overwhelm the Platform, for
example via denial-of-service attacks or similar interference.
-
Misrepresentation and Impersonation: Do not impersonate any person or entity, or falsely represent an affiliation with any person or entity. For instance, you should
not pretend to be another user, an instructor, a Company employee, or a celebrity. Likewise, do not give the impression that any content you might post is endorsed by us if it is
not.
-
Harassment and Abuse: Do not harass, bully, or abuse other users. This includes using hateful or discriminatory language, sending unwelcome messages, or engaging in
any form of intimidation. Everyone deserves a safe and positive learning environment.
-
Commercial Activities: You may not use the Platform for any commercial purpose not expressly approved by us. This means you cannot advertise products or services,
solicit users for business, or run contests or schemes through our Platform without permission. The Platform is meant for personal learning, not to conduct outside business.
-
Circumventing Policies: Do not attempt to circumvent or ignore these Terms or any policies we set. For example, do not try to create multiple accounts to get around
account restrictions, and do not use techniques to bypass the course completion tracking to claim an unwarranted refund. Any attempt to exploit the Platform in a way not intended by
us is prohibited.
Consequences of Violations: If you engage in any of the above prohibited activities or otherwise violate these Terms, we may take action including suspending or terminating your
account without notice, removing or disabling content you have contributed, and, if necessary, involving law enforcement or pursuing legal action. We also reserve the right to take any
preventive action to ensure compliance (such as blocking users or IP addresses associated with violators). Our goal is to ensure the Platform remains a positive and secure space for
learning. If you notice any violation of these rules by another user, or if you have concerns about any content or behavior on the Platform, please report it to us immediately (see
Section 11 for how to contact us). We will review all reports and take appropriate action.
9. Limitation of Liability
Use at Your Own Risk: You understand and agree that you use our Platform and Services at your own risk. While we strive to provide high-quality content and a reliable experience, the
Platform and all its content are provided on an "as is" and "as available" basis. We make no guarantee that the Services will be uninterrupted, timely, secure, or error-free. We do not
warrant that the results obtained from using the Services (for example, educational outcomes or skill improvements) will meet your expectations. No Warranty: To the fullest extent
permitted by law, the Company disclaims all warranties (express or implied) regarding the Services. This includes any implied warranties of merchantability (that the service is of
standard quality), fitness for a particular purpose (that it will meet your specific needs), and non-infringement. For example, we do not guarantee that completing a course will
guarantee you a job or a certain exam score, and we do not promise that the content is error-free or that any software features will always function without issues.
Limited Liability: To the maximum extent permitted by law, in no event shall the Company or its directors, officers, employees, partners, or content providers be liable for any
indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Platform. This includes, for example, any loss of
data, loss of profits, business interruption, or personal injuries indirectly resulting from use of our Services. In all cases, the Company's total aggregate liability for any claim
arising from or related to the Services shall be limited to the amount you paid to us for that specific course or service. If you have not paid anything (for example, if you only used
free content), or if the law does not allow the exclusion or limitation of certain damages, the above limitation may not apply to you to that extent. However, even in such cases, our
liability will be limited to the fullest extent permitted by law. Third-Party Content: Where our Platform includes links to third-party websites or content, or uses third-party tools
or services, those are provided for your convenience. We do not have control over third-party content and do not assume any responsibility or liability for it. Accessing any
third-party site or service is at your own risk and subject to their terms and policies. No Liability for Educational Outcomes: You acknowledge that every learner is different, and
results will vary. The Company is not liable for any failure to achieve particular outcomes or goals by using the Platform. For instance, if you use our courses to study for an exam,
we are not responsible if you do not pass the exam. Our content is meant to aid your learning, but ultimate success depends on many factors outside our control.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damages. Nothing in these Terms is intended to exclude liability
which cannot be excluded under law. In any case, you agree that the Company's liability will be limited to the extent permitted by law. If you are dissatisfied with any part of the
Service or these Terms, your sole and exclusive remedy is to discontinue using the Platform.
10. Governing Law (India)
These Terms and your use of the Platform are governed by the laws of India, without regard to its conflict of law principles. By using our Services, you agree that any dispute arising
out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of India. We reserve the right to choose the venue of such jurisdiction,
and we typically will select the courts located in the city/state where our Company is registered (for example, New Delhi, India, if our headquarters are there).
If any provision of these Terms is found to be unlawful or unenforceable by an Indian court of competent jurisdiction, that provision will be enforced to the maximum extent permissible
and the remainder of the Terms will remain in full effect. Our failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless
acknowledged by us in writing.
